VAT Registration

Belgian VAT Number Format

BE 0XXX.XXX.XXX

The VAT number equals "BE" + your 10-digit CBE enterprise number.

How to Register for Belgian VAT

The registration process depends on whether your business is already registered with the CBE (Crossroads Bank for Enterprises):

  1. Obtain a CBE enterprise number — required before VAT registration. If registering a new company, this happens automatically. Foreign companies without a Belgian entity use Form 604A.
  2. Submit VAT registration form — file Form 604A (new registration) or 604B (change) with your local VAT office or via an authorised tax representative.
  3. Receive VAT number — typically issued within 5–10 business days. Format: BE 0XXX.XXX.XXX.
  4. Activate Intervat access — log in to Intervat using your Belgian eID or via a tax representative mandate. All VAT returns must be filed electronically.
  5. File first VAT return — monthly filers submit by the 20th of the following month; quarterly filers by the 20th of the month after the quarter ends.

Small Enterprise Exemption

Businesses with annual turnover below €25,000 (excl. VAT) can opt for the VAT exemption scheme:

  • Do not charge VAT to customers
  • Cannot deduct input VAT on purchases
  • Must still register for VAT (exempt status)
  • Exempt from periodic VAT returns
  • Must state exemption on all invoices

Key VAT Concepts

Input VAT Deduction

VAT-registered businesses can deduct VAT paid on business purchases (input VAT) from VAT charged to customers (output VAT). Key rules:

  • Full deduction — on goods/services used exclusively for taxable activities
  • Partial deduction (pro-rata) — if you have both taxable and exempt activities
  • Non-deductible — entertainment (50%), restaurant meals (non-business), tobacco, alcohol, personal use, gifts
  • Company cars — deduction limited based on business use percentage (max 50% for private use)

Reverse Charge Mechanism

The reverse charge shifts VAT liability from seller to buyer in specific situations:

  • Intra-community acquisitions — B2B purchases from other EU countries
  • Services from foreign suppliers — B2B services received from non-Belgian companies (B2B general rule)
  • Construction work — Article 20 reverse charge for subcontracted construction services
  • Import VAT — can be self-assessed under the ET 14000 license (postponed accounting)

Intra-Community Supplies

B2B sales to VAT-registered buyers in other EU countries are zero-rated (0% VAT) if:

  • The buyer provides a valid EU VAT number (verifiable via VIES)
  • The goods are physically transported to another EU member state
  • The seller has proof of transport (CMR, tracking, delivery confirmation)
  • The transaction is declared on the intra-community listing

E-Commerce & One-Stop Shop (OSS)

For B2C cross-border sales within the EU (distance selling):

  • EU threshold: €10,000 aggregate annual B2C sales to other EU countries
  • Below threshold: charge Belgian VAT
  • Above threshold: charge destination country VAT, file via OSS in Belgium (avoids multiple VAT registrations)
  • Import One-Stop Shop (IOSS): for B2C imports of goods valued under €150 from non-EU countries

How to Register for OSS in Belgium

If your B2C EU sales exceed €10,000, register for the Union OSS scheme instead of registering for VAT in each EU country:

  1. Log in to Intervat with your Belgian VAT credentials.
  2. Navigate to One Stop ShopRegister for OSS.
  3. Select Union scheme (for EU-established sellers) or Non-Union scheme (for non-EU sellers using Belgium as their single point of registration).
  4. Provide business details, EU sales countries, and estimated turnover per country.
  5. File quarterly OSS returns by the last day of the month following each quarter. Pay the total VAT due in one payment to the Belgian tax authority, which then distributes it to each member state.

OSS eliminates the need for multiple EU VAT registrations — a significant administrative saving for e-commerce businesses selling across Europe.

VAT Invoicing Requirements

Belgian VAT invoices must include:

  • Supplier's name, address, and VAT number
  • Customer's name, address, and VAT number (for B2B)
  • Invoice date and sequential invoice number
  • Description of goods/services
  • Quantity and unit price (excl. VAT)
  • Applicable VAT rate(s) and VAT amount
  • Total amount incl. VAT
  • Reference to exemption or reverse charge (if applicable)

VAT Penalties and Interest

Belgium enforces strict VAT compliance. Key penalties to be aware of:

  • Late filing: €25–€500 per return depending on how late and frequency of offence
  • Late payment: 0.8% per month on the outstanding balance (9.6% annualised)
  • Non-registration: fine of up to €5,000 plus back-payment of all VAT due
  • Incorrect invoicing: fines up to 100% of the VAT incorrectly stated
  • Fraud: criminal prosecution for deliberate VAT fraud

VAT Refunds

If input VAT exceeds output VAT in a period, the balance is:

  • Carried forward to the next period (default), or

  • Foreign businesses not registered in Belgium can reclaim Belgian VAT via the EU electronic refund procedure (Directive 2008/9/EC) or the 13th Directive procedure (non-EU businesses).
